Change of employer or function of a foreigner

Headhunting of specialists (third-country nationals) who are already working in Lithuania is becoming an increasingly popular practice. Different rules apply for EU Blue Card holders and ordinary residence permit holders.

As regards EU Blue Card holders, changing a employer within the first 12 months of work in Lithuania requires an EU Blue Card holder to apply for permission from the Migration Department. We assist our clients, typically new employers, in planning and completing this procedure smoothly to ensure a seamless transition for the new employee from both employment and immigration perspectives.
After 12 months have passed since receiving the first EU Blue Card, a foreigner is allowed to change employers without advanced approval from the Migration Department. However, an EU Blue Card holder is required to notify the Migration Department about the change of employer within 7 business days.
If EU Blue Card holders intends to change the role (function) at the same Employer as a result of promotion or other reasons, there is no need to obtain a permission from the Migration department.
Regarding foreigners holding "ordinary" temporary residence permits for work purposes in Lithuania, they are required, in all cases, to obtain advanced approval for a change of employer or a change in their role/function within the same employer. A request for approval may be submitted to the Migration department at least 6 months after the date of issue of a temporary residence permit.
In all cases of change of the employer, it is important for new employers not to forget to submit 1-SD and LDU notifications at least 1 business day before the start day.
